Eligibility

Who can apply

MFSA authorisation first

The family office structure must be authorised by the Malta Financial Services Authority before an application proceeds. Branches of foreign family offices can qualify if the setup is proportionate.

Who can apply

Non-EU ultimate beneficial owners (UBOs) and qualifying senior employees linked to an MFSA-authorised family office entity or branch.

Structure

Family offices typically operate through vehicles such as holding companies, trusts or funds. Authorisation can take several forms — licences, registrations or approvals under laws including the Investment Services Act.

Benefits

Why this route works

No fixed upfront investment

This route skips the mandatory government contribution or property purchase that standard residency programmes require. Costs come instead from entity setup, regulatory compliance and immigration due diligence.

Full residence rights

Successful applicants gain the right to live, work and study in Malta. Non-EU nationals also gain Schengen Area access and short-stay travel rights.

Remittance-based taxation

Non-domiciled residents pay tax only on Malta-source income and on foreign income remitted to Malta. Senior employees at qualifying family offices can access preferential flat rates under Legal Notice 250 of 2025.

A complete financial ecosystem

Banks that understand private wealth, licensed trustees, fund administrators and legal counsel — so families keep control of investments while outsourcing administration and compliance.

When was this scheme introduced?

Is approval guaranteed?

No. The Residency Malta Agency oversees applications with the MFSA assessing fitness and properness. Approval remains discretionary and follows standard immigration grounds for refusal.
